Cold Creek Nurseries – SMS Marketing Terms of Service

Effective date: September 16, 2026

By opting into Cold Creek Nurseries' SMS/text messaging program, you agree to the following terms.

1. Program Description
Cold Creek Nurseries ("we," "us," "Cold Creek") sends promotional and transactional text messages, including sale announcements, event and workshop reminders, new arrivals, seasonal planting tips, order and appointment updates, and exclusive offers, to customers who opt in.

2. How You Opt In
You consent to receive messages by [checking the SMS opt-in box at checkout or signing up via our website form. Consent to receive marketing texts is not a condition of any purchase.

3. Message Frequency
Message frequency varies, but you can expect up to 10 messages per month. 

4. Cost
Message and data rates may apply. Message frequency depends on your carrier plan; charges are billed by your wireless carrier, not by Cold Creek Nurseries.

5. Opt-Out
You can cancel at any time by texting STOP to the number you received messages from. After you send STOP, we will send one final confirmation message, then no further messages will be sent to you unless you opt back in. Other recognized opt-out keywords: UNSUBSCRIBE, CANCEL, END, QUIT.

7. Carrier Liability
Carriers are not liable for delayed or undelivered messages. Not all mobile devices or carriers may be supported.

8. Supported Carriers
Supported carriers currently include AT&T, T-Mobile, Verizon, and most major US carriers. Coverage may vary.

9. Privacy
Your phone number and any information collected through this program is handled according to our Privacy Policy. We do not sell or share mobile opt-in data with third parties for marketing purposes.

10. Changes to the Program
We reserve the right to change or cancel our SMS program, or update these terms, at any time. Continued participation after changes take effect constitutes acceptance of the new terms.

11. Eligibility
You must be 18 years or older, or have parental/guardian permission, to participate in this program, and be a subscriber to the phone number you're providing.

12. Dispute Resolution
Any dispute arising from this SMS program will be resolved through binding arbitration under the Federal Arbitration Act, on an individual basis. Class actions and jury trials are waived.
